affirmed The General Authority for Endowments the permissibility, according to Islamic law, of allocating endowments for the benefit of children without requiring proof of poverty. It called for the formulation of precise administrative conditions to ensure the sustainability of assets andprevent future disputes among beneficiaries.
The Authority clarified that endowments are not limited to those in need, but extend to achieving familial, social, or educational goals as determined by the endower according to what they deem to be in the best interest of their family.
It explained that endowments for children are classified as a legitimate form of family endowment, which plays a pivotal role in supporting family stability and strengthening the values of financial solidarity among its members.
Distribution of financial returns
The Authority indicated that this type of financial arrangement provides the parent with an ideal opportunity to manage their funds sustainably, ensuring the continued benefit and regular inheritance of its returns across successive generations.
It emphasized the necessity of meticulously documenting the endowment's objectives and conditions during its establishment to avoid any future disputes or conflicts among the children.
It also highlighted the importance of the endowment document including clear mechanisms for distributing the financial proceeds, a precise definition of the rules governing the use of the funds, and a clear division of administrative responsibilities for the endowment trustees to guarantee its continuity and success.
