The Ministry of Commerce blocks an online store for exploiting national symbols
A firm measure to protect national symbols
In a decisive move reflecting the authorities' commitment to enforcing regulations and protecting the Kingdom's standing, the Saudi Ministry of Commerce announced the blocking of an online store that violated applicable laws. This firm decision came after the discovery of advertisements and products displayed within the store that illegally exploited personal images of national symbols and state officials to market its products and increase sales through misleading and unauthorized means.
Legal basis and royal decrees
The Ministry of Commerce clarified in its official statement that this violation primarily involves the store's exploitation of images of national symbols and officials in marketing and commercial transactions. This prohibition is based on the circular issued to commercial establishments, which was implemented pursuant to Royal Decree No. (3587) dated 21 Muharram 1440 AH. This Royal Decree prohibits the use of the state emblem (the two crossed swords and palm tree) and images of symbols and officials in any commercial transactions, whether in advertisements, products, publications, or promotional gifts.
Historical context and importance of the decision
Historically, the Kingdom of Saudi Arabia has placed great importance on protecting its official emblem, images of its leaders, and its symbols from any commercial exploitation that might compromise its prestige or suggest government support for certain products or services. This prohibition is not new; rather, it is an extension of long-standing policies aimed at completely separating sovereign symbols from purely profit-driven activities. The use of images of the leadership in commercial advertisements can mislead consumers, as some may believe that these products have official endorsement. This constitutes a form of commercial deception that the Ministry is vigorously combating to protect consumer rights.
Economic impact and regulation of e-commerce
On a local and economic level, this regulatory measure is of paramount importance in organizing the rapidly growing e-commerce sector in the Kingdom, in line with the objectives of Saudi Vision 2030. By imposing these penalties and blocking non-compliant stores, the Ministry of Commerce sends a clear message to all investors and entrepreneurs about the necessity of adhering to market ethics and applicable regulations. This firm stance contributes to creating a fair business environment, protects compliant stores from unfair competition, and enhances consumer confidence in the Saudi e-commerce market.
Continuous monitoring tours to detect violations
In a related context, the Ministry of Commerce emphasized that regulations strictly prohibit the use of images of national symbols and officials, as well as their names, in publications, goods, products, media releases, and personal gifts, considering this a clear violation punishable by law. The Ministry affirmed that its inspection teams will continue to conduct intensive and ongoing inspection tours of all online stores and traditional markets to detect such violations. The Ministry also called upon all consumers to cooperate and report any commercial violations they observe through the "Commercial Report" application or via the unified call center, stressing that it will not hesitate to take all necessary and strict legal measures against anyone who attempts to manipulate regulations or exploit national symbols for financial gain.
