Introduction to copyright regulation in Saudi Arabia

In a strategic move aimed at fostering a creative environment and protecting creators' rights, the Saudi Authority for Intellectual Property (SAIP) has released an explanatory memorandum for the draft regulations governing the licensing of collective management activities for copyright and related rights holders. This important initiative aligns with the Kingdom of Saudi Arabia's efforts to govern the intellectual property sector, regulate revenue collection mechanisms, and maximize the value of national creative assets to benefit the local economy.

Historical context and development of intellectual property in the Kingdom

Historically, the Kingdom of Saudi Arabia has witnessed fundamental and continuous transformations in the field of intellectual property protection, culminating in the establishment of the Saudi Authority for Intellectual Property (SAIP) as the unified umbrella and reference point for all areas of intellectual property. This institutional development aligns with the objectives of Saudi Vision 2030, which places great emphasis on the knowledge and creative economy. SAIP has revealed that the new regulations aim to prepare for the launch of the first collective body dedicated to regulating copyright activities, based on Cabinet Resolution No. 560.

Details of the draft collective management regulations

The explanatory memorandum clarified that the project grants collective management bodies broad legal powers to represent their members—creators and authors—before the competent judicial authorities, thus facilitating the protection of their rights. The draft also includes precise and rigorous conditions for granting licenses, specifying standard durations and renewal mechanisms. To ensure full compliance, deterrent penalties and sanctions have been established for anyone who violates the regulations, guaranteeing a transparent and fair working environment for all.
