New Explosives Regulations: Import Requirements and Destruction Controls

In a move aimed at strengthening public safety and security, the Saudi Ministry of Interior has published the executive regulations for the Explosives and Fireworks Law on the "Istilaa" platform, enabling the public and relevant authorities to provide their feedback. This step comes as part of the Kingdom's efforts to modernize its security legislation in line with the goals of Vision 2030 to develop the regulatory environment and ensure the highest safety standards in handling hazardous materials.

The context of the organization and its security and economic importance

Regulating the explosives and fireworks sector is a cornerstone of national security, with implications extending beyond security to encompass economic and developmental aspects. Explosive materials are vital components in infrastructure projects, mining, and road construction, necessitating a legal framework that is both flexible and firm. The new regulations aim to close any loopholes that could be exploited for the illicit trade of these materials, while simultaneously streamlining procedures for companies that adhere to standards, thereby enhancing the attractiveness of the investment environment in the industrial and entertainment sectors.

Strict requirements for permits and storage

The new regulations stipulate precise mechanisms for issuing permits, whereby applications are subject to thorough review by specialized security and technical committees. Permits are valid for two to four years, renewable, depending on the type of activity and the issuing authority (Director of Public Security or Regional Police Chief). Regarding storage, the regulations establish specific technical standards, including:

  • Leave safe distances between storage stacks (90 cm) and between walls (50 cm) to ensure ventilation.
  • Use non-sparking tools when handling boxes.
  • Prohibit the storage of any foreign materials in explosives depots.
  • Remove weeds and grasses surrounding warehouses to prevent fires.

Regulating transportation and banning Hajj seasons

The regulations paid particular attention to the transport of explosives due to their high risk. They stipulated direct security supervision and prior authorization for every transport operation. Taking into account the large crowds and security conditions during the Hajj season, the regulations prohibited the transport of explosives in Mecca and Medina from the 20th of Dhu al-Qi'dah to the 25th of Dhu al-Hijjah, and in other regions of the Kingdom during specific periods of the same season. International carriers were also required to notify Saudi Interpol and relevant authorities two weeks prior to the arrival of shipments.

Import conditions and financial guarantees

To ensure seriousness and financial solvency, the regulations set 13 conditions for importing fireworks, the most prominent of which are:

  • The importer must be a Saudi national or a company owned by Saudis with a minimum of 51% ownership.
  • Providing an unconditional bank guarantee of 200,000 riyals in favor of the Ministry of Interior.
  • Providing an economic feasibility study and an electronic inventory control system.
  • The owners' criminal record is free of any prior offenses that compromise security.

Regulations for damage and safety in stadiums and events

The regulations also addressed the disposal of expired or damaged materials, establishing six strict controls for their destruction. These controls require the presence of a committee comprising representatives from the Civil Defense, the Red Crescent, and explosives experts, with the entire process documented with audio and video recordings. Regarding entertainment and sports, the regulations governed the use of fireworks and smoke flares in stadiums, stipulating the approval of the Ministry of Sports and the Civil Defense, and specifying precise quantities and times of use to ensure the safety of spectators and facilities.
