Saudi Ministry of Commerce shuts down misleading online store

Strict regulatory efforts to protect consumers

In a decisive move reflecting the regulatory authorities' commitment to protecting consumer rights, the Saudi Ministry of Commerce announced the seizure of an online store specializing in perfumes and oud, after it was found to be misleading shoppers through deceptive online advertisements. These actions are part of the Ministry's ongoing efforts to rid the market of illegal practices.

Details of the online fraud incident

The incident unfolded when the Ministry's monitoring teams detected a promotional advertisement posted by the store on one of its official social media accounts. The advertisement included enticing promises of a valuable gift for every customer upon purchase, using the catchy phrase: "Surprise of the season... Everyone gets an iPhone." However, upon investigation and following up on complaints, the Ministry discovered that the store had not honored the advertised promise. Consumers were surprised to receive entirely different and significantly less valuable devices than the advertised smartphones, constituting blatant deception and manipulation of shoppers' trust.

A clear violation of e-commerce regulations

Accordingly, the Ministry of Commerce promptly summoned the operators of this online store and immediately referred them to the Committee for Reviewing Violations of the Electronic Commerce Law. This step was taken to implement deterrent legal measures against them, given their clear violation of Article Eleven of the Electronic Commerce Law and its Implementing Regulations. This article clearly states: “It is prohibited to include in an electronic advertisement any offer, statement, or claim that is false or phrased in a way that could directly or indirectly deceive or mislead the consumer.”.

General context and development of e-commerce in the Kingdom

Historically, Saudi Arabia has witnessed a tremendous boom in the e-commerce sector, particularly with the supportive initiatives within Saudi Vision 2030, which aims to digitize the economy and facilitate business operations. With this rapid growth, the need arose for a robust regulatory environment to protect all parties. Therefore, the e-commerce law was established to serve as a safeguard, ensuring the transparency and reliability of transactions and preventing any practices that could harm the national digital economy.

Local and regional impact of regulatory measures

The significance of this event extends far beyond simply shutting down a non-compliant store; it sends a powerful message both locally and regionally. Locally, these measures bolster consumer confidence in the Saudi market and ensure fair competition between compliant businesses and those attempting to circumvent regulations. Regionally, the Kingdom reaffirms its leadership in implementing best regulatory practices to safeguard the digital economy, making the Saudi market an attractive and secure environment for reliable investments.

Deterrent sanctions and a call for cooperation

It is worth noting that the Ministry of Commerce continues its diligent efforts in monitoring and tracking online advertisements on a regular basis. The Ministry refers violators to specialized committees that have the authority to issue strict penalties, including fines of up to one million Saudi Riyals, in addition to blocking and closing offending websites and permanently banning the business from operating. The Ministry calls upon all consumers to cooperate and report any suspicious commercial practices or misleading advertisements through the “Commercial Report” application or through official channels, to ensure a healthy and regulated business environment.
