«المشتريات الحكومية»: رفع سقف الشراء المباشر إلى مليون

كشف نظام المنافسات والمشتريات الحكومية الجديد عن حزمة من التعديلات التي تستهدف تسريع إجراءات التعاقد الحكومي، ورفع كفاءة الإنفاق، وتعزيز فرص القطاع الخاص، إلى جانب دعم المحتوى المحلي والبحث والتطوير والابتكار، ليحل محل النظام الصادر عام 1440هـ.

ومن أبرز التغييرات التي حملها النظام رفع سقف الشراء المباشر من 100 ألف ريال إلى مليون ريال، مع توسيع نطاق الحالات التي يجوز فيها اللجوء إلى هذا الأسلوب، ليشمل مجالات جديدة، من بينها البحث والتطوير والابتكار، والرخص والبرامج الإلكترونية، والاشتراكات في المواقع، والتدريب، وحجز المساحات في المعارض والمؤتمرات، إضافة إلى التعاقد مع ممارسي المهن الحرة.

وفي إطار تقليص الإجراءات وتسريع البت في المنافسات، دمج النظام لجنتي فتح وفحص العروض في لجنة واحدة، كما خفّض الحد الأدنى لفترة التوقف من 5 أيام إلى 3 أيام عمل، ورفع النظام كذلك سقف التفويض الممنوح من رئيس الجهة الحكومية للبت في الإجراءات من 10 ملايين إلى 50 مليون ريال.

وفي خطوة تعزز حقوق القطاع الخاص، وضع النظام قيداً يمنع الجهة الحكومية من إصدار ترسية جديدة في حال وجود مستحقات مالية غير مسددة للمتعاقدين، وذلك وفق الضوابط التي تحددها اللائحة، بما يعزز الالتزام بسداد مستحقات المنشآت.

كما أجاز النظام الدفع المقدم لكامل قيمة العقد في الحالات التي تحددها اللائحة، فيما رفع قيمة المشتريات المستثناة من تقديم الضمان النهائي من 100 ألف إلى 300 ألف ريال.

ووسع النظام أدوات دعم الاقتصاد المحلي، من خلال تنظيم توطين الصناعة ونقل المعرفة، إلى جانب وضع إطار خاص لدعم البحث والتطوير والابتكار، بما يعزز الاستفادة من المشتريات الحكومية في تنمية القدرات المحلية وتوسيع مشاركة القطاع الخاص.

وفي ما يتعلق بالعقود، خفّض النظام الحد الأقصى لغرامة التأخير في العقود ـ باستثناء عقود التوريد ـ من 20% إلى 15%، مع منح الجهات الحكومية مرونة أكبر في إصدار أوامر التغيير، وذلك ضمن الحدود والضوابط التي حددها النظام.

The new government procurement and competition system has revealed a package of amendments aimed at accelerating government contracting procedures, enhancing spending efficiency, and boosting opportunities for the private sector, along with supporting local content, research, development, and innovation, replacing the system issued in 1440 AH.

Among the most notable changes introduced by the system is the increase of the direct purchase ceiling from 100,000 riyals to 1 million riyals, along with expanding the scope of cases in which this method can be used to include new areas, including research, development, and innovation, licenses and electronic programs, subscriptions to websites, training, and booking spaces at exhibitions and conferences, in addition to contracting with practitioners of freelance professions.

As part of reducing procedures and speeding up the decision-making in competitions, the system merged the committees for opening and examining bids into one committee, and it also reduced the minimum standstill period from 5 days to 3 working days. Additionally, the system raised the ceiling for the delegation granted by the head of the government entity to decide on procedures from 10 million to 50 million riyals.

In a step that enhances the rights of the private sector, the system imposed a restriction preventing the government entity from issuing a new award if there are outstanding financial dues owed to contractors, according to the controls set by the regulations, thereby reinforcing the commitment to settle the dues of establishments.

The system also permitted advance payment for the full value of the contract in cases specified by the regulations, while raising the value of purchases exempted from providing the final guarantee from 100,000 to 300,000 riyals.

The system expanded the tools to support the local economy by organizing the localization of industry and knowledge transfer, in addition to establishing a special framework to support research, development, and innovation, thereby enhancing the benefits of government procurement in developing local capabilities and expanding the participation of the private sector.

Regarding contracts, the system reduced the maximum delay penalty in contracts—except for supply contracts—from 20% to 15%, while granting government entities greater flexibility in issuing change orders, within the limits and controls set by the system.
