مستشار قانوني لـ«عكاظ»: «سأفضح هذا الدوري» تضع فيليكس أمام الإيقاف والغرامة
يرى المستشار القانوني الدكتور عثمان عبدالوهاب عثمان، أن تصريح لاعب النصر البرتغالي جواو فيليكس «سأفضح هذا الدوري»، يفتح الباب أمام مساءلة تأديبية محتملة، وفقاً للتكييف القانوني للعبارة وما تقرره الجهات القضائية الرياضية المختصة في ضوء لائحة الانضباط والأخلاق بالاتحاد السعودي لكرة القدم لعام 2025.
وجاء تصريح فيليكس، في مقطع فيديو موثق تداولته منصات إخبارية عقب مباراة الاتحاد والنصر، التي انتهت بفوز الاتحاد بهدفين مقابل هدف، ليثير نقاشاً بشأن الحدود الفاصلة بين حرية التعبير والتصريحات التي يمكن أن تندرج ضمن المخالفات التأديبية.
الإساءة الإعلامية..
العقوبة قد تصل إلى الإيقاف عاماً
وأوضح عثمان، أن المادة 50 المتعلقة بالإساءة الإعلامية تضع مستويات مختلفة للعقوبة بحسب جسامة التصريح وتكييفه؛ إذ قد تصل الغرامة إلى 80 ألف ريال إذا اعتُبرت العبارة إساءة مباشرة إلى الاتحاد أو لجانه أو موظفيه، وفقاً للفقرة الثالثة.
وأضاف، أن العقوبة قد تصل إلى غرامة قدرها 100 ألف ريال، إذا ثبت أن التصريح يندرج ضمن إثارة الرأي العام أو استخدام عبارات منافية للأخلاق الرياضية، وفق الفقرة الرابعة.
وأشار إلى أنه في حال تكييف العبارة باعتبارها من قبيل التجريح أو الاتهام الجسيم، فإن الفقرة الخامسة تفتح المجال لعقوبة تصل إلى الإيقاف لمدة عام، وغرامة مالية تصل إلى 300 ألف ريال، إلى جانب العقوبات التبعية الواردة في المادتين 10 و11.
«واجب الولاء»..
غرامة لا تقل عن 50 ألفاً
ولفت المستشار القانوني إلى أن المادة (81)، المتعلقة بواجب الولاء، تحظر في فقرتها الأولى الإدلاء بتصريحات علنية تمس اعتبار الاتحاد أو تسيء إلى أي طرف في سياق المنافسات.
وبحسب عثمان، فإن مخالفة هذه المادة تستوجب غرامة لا تقل عن 50 ألف ريال، مع منح الجهات القضائية الرياضية صلاحية فرض تدابير وعقوبات إضافية وفقاً للفقرة الثانية.
النزاهة وصورة كرة القدم
وفي ما يتعلق بالمادة (83)، أوضح عثمان، أن الفقرتين الثانية والثالثة تُحملان أطراف اللعبة مسؤولية المحافظة على مكانة الاتحاد وصورته، والامتناع عن أي سلوك من شأنه الإضرار بسمعة كرة القدم والرياضة في المملكة.
وأضاف، أن الفقرة الخامسة تقرر غرامة مالية لا تقل عن 50 ألف ريال، مع إمكانية فرض عقوبات إضافية على المخالف.
التكييف القانوني يحسم العقوبة
وخلص المستشار القانوني الدكتور عثمان عبدالوهاب عثمان، إلى أن إطلاق عبارات تحمل تشكيكاً مفتوحاً قد يضع صاحبها تحت طائلة نصوص لائحة الانضباط والأخلاق، مشدداً على أن تحديد المخالفة والعقوبة يظل مرتبطاً بتكييف العبارة وسياقها وتقدير الجهات القضائية الرياضية المختصة.
وأكد، أن هذه النصوص تستهدف حماية المنظومة الرياضية من التجني والإساءة في الخطاب الإعلامي، بما يستوجب من أطراف المنافسات ضبط تصريحاتهم العامة وفق المعايير القانونية والتنظيمية المعتمدة، مضيفاً أهمية التوعية باللوائح وعدم مخالفتها.

Media Abuse..
The penalty could reach a one-year suspension
Othman explained that Article 50 related to media abuse sets different levels of penalties based on the severity of the statement and its interpretation; the fine could reach 80,000 riyals if the phrase is considered a direct insult to the federation, its committees, or its employees, according to paragraph three.
He added that the penalty could reach a fine of 100,000 riyals if it is proven that the statement falls under inciting public opinion or using phrases contrary to sports ethics, according to paragraph four.
He pointed out that if the phrase is interpreted as defamation or a serious accusation, paragraph five opens the door for a penalty of up to one year of suspension and a financial fine of up to 300,000 riyals, in addition to the subsidiary penalties mentioned in Articles 10 and 11.
“Duty of Loyalty”..
A fine of no less than 50,000
The legal advisor noted that Article (81), related to the duty of loyalty, prohibits in its first paragraph making public statements that harm the federation’s reputation or insult any party in the context of competitions.
According to Othman, violating this article warrants a fine of no less than 50,000 riyals, with the sports judicial authorities granted the authority to impose additional measures and penalties according to paragraph two.
Integrity and the Image of Football
Regarding Article (83), Othman clarified that paragraphs two and three hold the parties involved in the game responsible for maintaining the federation’s status and image, and refraining from any behavior that could harm the reputation of football and sports in the Kingdom.
He added that paragraph five stipulates a financial fine of no less than 50,000 riyals, with the possibility of imposing additional penalties on the violator.
The legal interpretation determines the penalty
Dr. Othman Abdulwahab Othman concluded that making statements that carry open doubts may place the speaker under the provisions of the disciplinary and ethics regulations, emphasizing that determining the violation and penalty remains linked to the interpretation of the phrase, its context, and the assessment of the relevant sports judicial authorities.
He affirmed that these provisions aim to protect the sports system from injustice and abuse in media discourse, necessitating that the parties involved in competitions regulate their public statements according to the established legal and regulatory standards, adding the importance of raising awareness of the regulations and not violating them.
