Salary payment delays in Saudi Arabia: Your rights and new enforcement procedures
The Ministry of Human Resources and Social Development in Saudi Arabia announced a significant regulatory step aimed at strengthening the protection of workers' rights and ensuring the stability of the contractual relationship between employees and employers. The Ministry clarified that if salary payment is delayed for more than 30 days from the due date, the worker has the right to take direct enforcement measures without the need for lengthy litigation, provided that their employment contract is registered through the "Qiwa" platform.
The development of labor systems within the framework of Vision 2030
This step comes as part of a series of comprehensive reforms in the Saudi labor market, aligned with the goals of Vision 2030. These reforms aim to create an attractive and safe work environment, enhance market efficiency, and conform to international best practices. This move follows other important initiatives, such as the Wage Protection Program, launched to ensure that salaries are transferred through approved banking channels, thus facilitating the monitoring of establishments' compliance with timely wage payments. The new procedure represents a qualitative leap, moving from the monitoring phase to one of empowerment and rapid implementation, providing workers with an effective legal tool to obtain their financial rights without delay.
Direct implementation mechanism in case of delayed salary payment
According to clarifications issued by the Ministry, an employment contract documented through the Qiwa platform acquires the status of an "enforceable instrument." This legal status means that the contract itself is considered an official document directly enforceable before the enforcement courts. Once 30 days have passed since the wages were due and have not been paid in full, the worker can file an enforcement request directly through the Ministry of Justice's Najiz platform. This mechanism eliminates the need to go through the stages of amicable settlement or file a labor lawsuit in labor courts, procedures that were previously time-consuming and labor-intensive. The Ministry emphasized the importance of the worker first verifying that their contract is documented and has acquired the status of an enforceable instrument through their account on the Qiwa platform.
Positive impact on the Saudi labor market
This decision is expected to have a multifaceted positive impact. Domestically, it gives workers, both citizens and residents, a greater sense of job security and confidence in the legal system, encouraging increased productivity and stability. It also incentivizes employers to adhere more closely to payroll schedules to avoid direct enforcement actions that could damage an establishment's reputation and record. Internationally, this measure enhances the attractiveness of the Saudi labor market to global talent and expertise, and improves the Kingdom's ranking in international labor rights indices, reflecting its commitment to providing a fair and transparent work environment.
