
The new Saudi enforcement system: deterrent penalties to protect rights
Historic judicial reforms within Vision 2030
In a historic move aimed at strengthening the rule of law and expediting justice, the Kingdom of Saudi Arabia has adopted a new enforcement system, representing a qualitative leap in the Saudi judicial system. This system comes as part of a broad package of legislative reforms adopted by the Kingdom within its Vision 2030, which aims to modernize legal systems in line with international best practices, enhance the investment and business environment, and safeguard the rights of all parties.
Historically, judicial enforcement procedures in the Kingdom have faced several challenges, most notably delays by debtors and attempts to conceal or smuggle funds, which have prolonged cases and undermined the authority of judicial rulings. Therefore, the new system was introduced to establish a robust criminal deterrent, aimed at protecting rights and preventing manipulation of enforcement procedures, through the imposition of strict and unprecedented penalties, including imprisonment for up to 15 years for certain offenses, with penalties doubled for repeat offenses.
Key features of the new enforcement system and its harsher penalties
The new system directly targets all forms of circumventing court rulings and criminalizes specific acts that constituted loopholes in the previous system. The most prominent penalties include:
- Combating money laundering and obstruction of enforcement: The system stipulates a prison sentence of up to three years, and a fine that may reach one million riyals, or one of these two penalties, for anyone who is proven to be involved in concealing or smuggling money with the intention of obstructing the fulfillment of rights, or deliberately refusing to implement enforcement orders, or providing misleading information to the court.
- Strict penalties for public employees: In a move reflecting the state’s commitment to integrity in public service, the system has increased the penalty to five years imprisonment for any public employee who is proven to have prevented implementation or obstructed its procedures, and this is considered a crime of breach of trust.
- Fifteen-year prison sentence for squandering large sums of money: The system imposes the harshest penalty, up to fifteen years imprisonment, if a debtor is found to have squandered large sums of money, even if they are proven insolvent. This act is considered a major crime warranting arrest, thus deterring major debtors.
- Family protection and personal status issues: The system did not overlook the family aspect, as it stipulated a prison sentence of up to ninety days, and a fine of up to thirty thousand riyals, for anyone who refuses to implement custody, visitation or guardianship rulings, thus ensuring the protection of the rights of children and the family.

The new implementation system has profound positive implications at the local, regional and international levels:
- At the local level, the system enhances citizens' and residents' trust in the judiciary, ensures the swift restoration of rights, reduces litigation time, and achieves prompt justice. It also contributes to the stability of commercial and financial transactions and protects family ties by enforcing respect for personal status laws.
- Regionally and internationally, the system sends a strong message to foreign investors that the investment environment in Saudi Arabia is safe and strongly protected by law, and that their rights are guaranteed by the latest deterrent legislation.
